Badge for Process Servers...Should I wear one?

The policy of EZ Messenger is that a server/vendor is not to wear a badge.

A common discussion in the industry... are process servers able to wear badges? Seems simple enough as a way to identify yourself or your purpose but a server is subject to local or state rules and laws and in some instances code of ethics.

The simple answer for EZ Messenger server vendors is NO.  Our policy is that vendors are not to wear badges.

Policy

To avoid the appearance of law enforcement and to prevent accusations of misleading the public, EZ Messenger policy prohibits the use or display of a badge or other distinguishing emblem while effectuating service of process.
A Service Vendor who works in law enforcement but serves process for EZM in a private capacity must not attempt to serve a document while wearing a law enforcement officer's uniform or a uniform that resembles a law enforcement uniform. A Service Vendor must not display a law enforcement badge or any badge that resembles a law enforcement badge.

Identification provided by licensing authorities may be used to provide proof of identity and purpose.

Here is an article providing common sense pointers but fails to consider the clear directives spelled out in the  Texas Judicial Branch Certification Commission (JBCC) code of ethics that prohibit the use of badges. The JBCC is administered by the Office of Court Administration of Texas as the Texas Process Server certification program. The issue is that the public relate badges to law enforcement. Vendors are not law enforcement. .
