How to properly document and check with Neighbors
Neighbor Attempts
Approaching neighbors to verify the occupancy of the defendants place of residence
Neighbor attempts are made for verification of the Defendants living status at the subject property. Once verification is made with a neighbor, and the vendor has properly documented this verification, there is no need to revisit the neighbor.
* Speak to the neighbor with courtesy, and respect. Make them feel at ease, and as comfortable as possible. Never be confrontational. Approach the person in a professional manner.
* Make an effort to get the name (if possible) and address of the neighbor you contacted, and include that information in the attempt notes.
If you cannot get the neighbors name, provide a detailed physical description, such as gender, Color/race, hair, height, weight, age in the attempt notes. The vendor is not required to continue attempts with neighbors if it's been established that the defendant is, or is not living at the property.
ALWAYS report findings from the neighbor in your attempt notes. Give a good description and/or name of the neighbor. If the neighbor does not answer their door, be sure to enter that information into your attempt notes.
EXAMPLES of poor comments:
* “The Neighbor confirmed….” what did the neighbor confirm? What is the name and/or description of the neighbor?
* “The Defendant no longer resides per male….” Who did you contact to confirm this? Where did you make contact to confirm this?
When the court considers the validity of the Affidavit, they are looking to descriptions such as:
* “The neighbor at 1234 Main St, white female, 5ft, 45-55 yrs old, confirms that the defendant , John Doe, resides at 1236 Main St. Neighbor would not give their name.
Vague statements on your attempt will create questions which will cause a need for clarification, possible delays of the process, and the ability for the vendor to get paid timely.
Note: Do not act on information given to you by someone in the field that contradicts the information on your Field Sheet, such as a different address. Any information given to you by someone in the field should be documented, with a description of the person, where you spoke to them, and then submit the job as a Problem.
